Ahmad Rosidi's Open Examination Assesses the Constitutional Authority of DPR and DPD

Denpasar – Ahmad Rosidi, an educator from the University of Mount Rinjani continued his doctoral degree (S3) at the Doctoral Study Program in Law, Faculty of Law, Udayana University. Thanks to his perseverance and struggle, the Doctoral degree can be achieved with the implementation of the Doctoral Promotion Open Examination on January 24, 2022 at the Hall of the Faculty of Law, Udayana University, this time the exam was also held with Hybrid Offline and Online media. Adopted a dissertation entitled "Reconception of the Authority of the Regional Representative Council in the Formation of the Law of the Republic of Indonesia".

The Doctoral Promotion Open Examination which lasted for 2 hours was led directly by the Deputy Dean for Academic Affairs and Planning, Dr. Pushed Putu Dewi Kasih, SH., M. Hum, Prof. Dr. I Made Subawa, SH., M. Hum as the Promoter, Dr. Gede Marhaendra Wija Atmaja, SH., M. Hum as Copromotor 1, Dr. Ni Luh Gede Astariyani, SH., MH as Co-promoter II, and was tested by 4 other examiner/debating boards.

In his dissertation, Ahmad Rosidi revealed that the functions of the powers of the DPR and the DPD are constitutionally unequal, so that in its implementation the existence and position of the DPR is much bigger and stronger than the Regional Representatives Council. The authority possessed by the Regional Representatives Council in this case is only "" authorityConsultative, because it does not have the authority to decide or give approval to a law, while the DPR has "very dominant" authority, where all the powers of the President have the involvement of the DPR then in terms of constitutional relations. The DPR and DPD have the same position, namely as part of the MPR members, from an institutional perspective, there is no relationship, only that they are state institutions, while in terms of their duties, they are related, especially those related to the field of legislation, while in terms of functions, they are clearly separated.
