Researcher Chat Loss of Citizenship

The Ministry of Law and Human Rights of the Republic of Indonesia Bali Regional Office on March 7, 2022 held the OPIni Lost Citizenship activity based on the Citizenship Law online and offline. The activity was opened by the Head of Research and Development of Law and Human Rights, Dr. Sri Puguh Budi Utami, M.Si and the Head of Regional Office of the Ministry of Law and Human Rights of Bali, Jamaruli Manihuruk, SH., MH, MM.

Presented by 3 (three) speakers: Director of State Administration, Dr. Barito, SH., MH.; Young Researcher for Research and Development of Law and Human Rights, Muhaiman, SH.; and Lecturer of the Constitutional Law Department, Faculty of Law, Udayana University, Dr. Gede Marhaendra Wija Atmaja, SH, M. Hum.

The activity was attended by various stakeholders including the Bali Mixed Marriage Community Association (PerCa).

The purpose of this OP is to convey facts on the ground (Bali is one of the places where mixed marriages occur) about the causes of the loss of Indonesian citizenship as well as recommendations to prevent/reduce the loss of citizenship.

From the results of the study, there are several factors that cause loss of citizenship: negligence (lack of updates regarding the requirements for determining citizenship choices), the system and a low level of awareness in reporting citizenship status.

Citizenship status is one of the universal human rights for everyone, recognized in Article 28D paragraph (4) of the 1945 Constitution. Therefore, the State (Indonesia) is obliged to respect, protect, fulfill human rights (acquisition of citizenship status) which the Citizenship Law does not know Bipatride and Apatride.

Thus, in the future, there needs to be socialization of the Indonesian citizenship system (causes of losing and regaining citizenship) and the development of an integrated (electronic) Citizenship Administration System that is connected to the Immigration Information System, Population Administration Information System and portal for Indonesian citizens in their respective agencies.(Suksma/ FH)
