Promovendus Liang Budiarta Successfully Received a Doctorate Degree at the Doctoral Program of Law Faculty of Law UNUD

 "Deconstruction of Good Faith Arrangements in Agreements Made Before a Notary" is the title of Liang Budiarta's Dissertation which was presented at the Doctoral Promotion August 11, 2022 at the Hall of FH Unud. Liang Budiarta works as a Notary in the Badung Regency area. The exam was led by the Dean of the Faculty of Law UNUD with the Promoter Team: Prof. Dr. Ida Bagus Wyasa Putra, SH., M. Hum, Dr. Pushed Putu Dewi Kasih, SH., M. Hum, Dr. Putu Tuni Cakabawa Landra, SH., M. Hum and 4 other examiners. The results of his research show that the regulation of the principle of good faith in Indonesia has been contained in various laws and regulations. However, the regulation of good faith in the Law on Notary Positions (UUJN) is still implicit and limited to the good faith of a notary. Good faith arrangements for the parties to the agreement have not yet been regulated. So that the regulation regarding good faith in the UUJN is still unclear which results in frequent deviations from the good faith. The result of the deconstruction of the arrangement of the good faith principle is the Construction Model of Moral Commitment of the Subject of the Agreement which is realized in the form of an Integrity Pact that was made before the agreement was made. In the future, it is expected that the Government as the initiator of the legislature will prepare a draft of the National Covenant Law which contains the provisions of the Moral Commitment Model of the Subject of the Agreement in the form of an Integrity Pact and instructs Notaries to attach an Integrity Pact without exception in every notarial deed.
