-The abolition of racial and ethnic discrimination is one of forms of human rights that its enforcement still to be fought for because there are still a lot of discrimination against particular race and ethnic in the world. Especially with the improvement of globalization and the vast influence of internet technology, so cyber world becomes one of the medias that is often used as a tool to spread informations that suggests an element of hatred against particular race and ethnic. Cyber racial and ethnic discrimination is still difficult to be given criminal sanctions because there is no substance of regulation that explicitly control it. The abolition of racial and ethnic discrimination is specifically regulated in ICERD, while the regulation for the content of internet just regulated in Convention on Cybercrime. The writing of this paper will use normative legal method to analyze and compare between national law and international law relating to the abolition of cyber racial and ethnic discrimination, so the legal substance that is required can be identified in an effort to prevent cyber racial and ethnic discrimination. Based on these legal materials, this paper will explain the legal substance that should be made into international legal instruments relating to the abolition of cyber racial and ethnic discrimination.
