DAMAGES FOR LOSS OF BIRTH OF PASSENGERS BY AIR TRANSPORTATION: STUDY IN. LION MENTARI AIRLINES DENPASAR

As one of the largest private airline company in Indonesia, PT. Lion Air is obliged to keep the airlift activities in an orderly, safe, comfortable and efficient in accordance with what is aspired to the Act 1 of 2009 on Aviation. PT. Lion Air is also obliged to provide similar service to their passengers flying tebaik for the sake of the implementation of the airlift comfortable. In conducting airlift, the work done by PT. Lion Air does not always work perfectly. Air freight activity, does not escape from any event that could harm either party, such as a plane crash, flight schedule delays, and lost or damaged luggage passengers. This thesis discusses the indemnity air conveyance for lost or damaged luggage in baggage, in terms of theories or principles indemnity carrier and legislation related, namely Law No. 1 Year 2009 on Aviation, Law No. 8 of 1999 on Consumer Protection and Regulation of the Minister of Transportation No. 77 Year 2011 on on the Responsibility of Carrier Air Transport. This research uses empirical legal research through interviews with staff Lost and Found airport Ngurah Rai . Interviews were conducted with Junior Chief Lost and Found , Ground Handling and Passenger Handling Coordinator Lost and Found office Ngurah Rai airport. This study used the approach to the fact ( the fact approach) and the approach of legislation ( the statute approach). The results showed that the amount of indemnity against luggage baggage lost or damaged property of passengers by PT . Lion Air is not in accordance with the Regulation of the Minister of Transportation no. 77 in 2011 amounted to Rp . 200.000 , - per kilogram . Compensation PT . Lion air for lost or damaged luggage , as high as Rp . 20.000 , - per kilogram.
